PCH Wine & Spirits — Website Legal Notice & Online Sales Policy

PCH Wine & Spirits (“PCH,” “we,” “our,” or “us”) is a California-licensed retailer. By accessing our website or placing an order, you agree to the terms below.

1) Age & Identity Verification

  • You must be 21 years of age or older to purchase alcohol. We verify age at checkout and at delivery/pickup. We reserve the right to refuse or cancel any order if valid proof of age is not provided.
  • We do not sell or furnish alcohol to anyone under 21 or to any obviously intoxicated person. Violations are a crime under California’s Business & Professions Code.

2) Hours of Sale (California)

Online orders for alcohol (including delivery or pickup) may only be finalized, released, or delivered during lawful California retail hours: 6:00 a.m. to 2:00 a.m. It is unlawful to sell or purchase alcohol between 2:00 a.m. and 6:00 a.m. PCH will not complete transactions or deliveries during prohibited hours.

3) Delivery, Curbside Pickup & Third-Party Services

  • Adult Signature Required (21+): A recipient 21+ with valid government ID must be present to sign; carriers will not leave alcohol unattended and may refuse delivery to persons who are visibly intoxicated. No P.O. Boxes.
  • If no eligible adult is available, carriers will reattempt delivery; additional fees may apply.
  • When PCH uses a third-party delivery service, that service acts as our agent, and PCH remains responsible for legal compliance (including no sales to minors). We therefore control the transaction and require our delivery partners to follow our ID-check and refusal policies.

4) Shipping & Jurisdiction

  • We only ship or deliver to jurisdictions where permitted by law and only to addresses that allow receipt of alcohol. We may cancel any order that cannot legally be fulfilled. (Carriers require shipment labeling and an adult signature (21+).)
  • Title and risk of loss transfer according to applicable law at the point the order is picked up by the carrier or delivered to you; however, PCH does not ship where doing so would violate origin or destination laws.

5) Order Acceptance, Substitutions & Errors

  • All orders are offers to purchase subject to acceptance and availability. Product vintages, labels, and images may vary from photos. We may limit quantities, refuse, or cancel orders (e.g., pricing/stock errors, age/ID issues, delivery restrictions).
  • Pricing and availability may change without notice; charges will reflect the final accepted order.

6) Returns, Cancellations & Breakage

  • Alcoholic beverages are generally not returnable where prohibited by law. If you receive damaged goods, please photograph the package and notify us within 48 hours of delivery; we’ll assist consistent with carrier rules and applicable law.

7) Responsible Service & Refusals

We will refuse service or delivery if: (a) the customer or recipient is under 21; (b) the recipient appears intoxicated; (c) the order would be completed during prohibited hours; or (d) completing the sale would otherwise violate the Alcoholic Beverage Control Act.

8) Health & Safety Warnings

  • Federal Health Warning (ABLA/TTB):
    “GOVERNMENT WARNING: (1) According to the Surgeon General, women should not drink alcoholic beverages during pregnancy because of the risk of birth defects. (2) Consumption of alcoholic beverages impairs your ability to drive a car or operate machinery, and may cause health problems.”
  • California Proposition 65 — Alcohol:
    “WARNING: Drinking distilled spirits, beer, coolers, wine and other alcoholic beverages may increase cancer risk, and, during pregnancy, can cause birth defects. For more information go to www.P65Warnings.ca.gov/alcohol.”
    PCH provides Prop 65 warnings online before checkout and at physical points of sale, consistent with OEHHA “clear and reasonable” warning methods (including website display on product pages or prominently prior to completion of purchase).
  • 9) Accessibility (ADA) — Website & Mobile

PCH is committed to ensuring that our digital content is accessible to people with disabilities.

  • Standard: We aim to conform our website and mobile experiences to WCAG 2.1 Level AA and to follow the U.S. Department of Justice guidance on web accessibility for businesses open to the public under ADA Title III.
  • Assistance & Feedback: If you use assistive technologies (screen readers, magnifiers, voice recognition, captions, keyboard navigation, etc.) and encounter a barrier, or if you need an auxiliary aid or service or a reasonable modification, please contact us using the information in Section 14. We will respond and work to provide the content you need in an accessible format.
  • We routinely review key user flows (browsing, cart, checkout, account, PDFs/media) for accessibility and welcome usability feedback to improve equal access.

Note: Although the DOJ’s 2024 web rule establishes technical standards for Title II (state/local governments), the DOJ’s 2022 guidance confirms that businesses open to the public must provide accessible web content under Title III; many settlements reference WCAG as a benchmark. PCH follows these best practices.

10) Open-Container & To-Go Limitations

If PCH offers any non-manufacturer-sealed “to-go” beverages (e.g., cocktails) as permitted by changing law, they may not be delivered and must comply with all ABC conditions (e.g., bona fide meal, sealing/labeling). Otherwise, such items will not be sold for delivery.

11) Taxes & Fees

Applicable sales/use taxes, CRV, recycling fees, deposits, shipping/delivery, and adult-signature/ID verification fees are added at checkout according to the delivery/pickup location and carrier policies.

12) Privacy

Please review our Privacy Policy for details on personal information we collect (including identity/age-verification data) and how we use and protect it.

13) Limitation of Liability

To the fullest extent permitted by law, PCH disclaims liability for incidental or consequential damages arising from your purchase or use of products obtained through our site. Drink responsibly; never drink and drive. Nothing in this section limits rights that cannot be disclaimed under applicable law.

15) Governing Law & Dispute Venue

These terms are governed by the laws of the State of California and applicable U.S. federal law. Venue and jurisdiction for disputes shall lie in the state or federal courts located in the county of our principal place of business in California.

We may update this Notice at any time. Material changes will be posted on this page with a new “Last updated” date.
